Municipal authorities are authorised to make bylaws by specific legislation, or through powers vested in the governor-general. The authority under which a bylaw is made is set out in the in the first paragraph of the bylaw.
Bylaws may 'incorporate' other regulatory mechanisms, for example the Wellington City Consolidated By-Law Amendment No 24 (Building) 1940 created a bylaw around the then current New Zealand Standard Code of Building ByLaws, Parts I-VI.
The general form of the bylaw also includes the title, the date the bylaw came into force, what areas it applied to, whether it should be read together with other bylaws, what bylaws, if any, are amended, and which, if any, are repealed. Bylaws must be 'signed and sealed' in order to be valid. This requires that the seal of the corporation must be affixed to the document, in the presence of the Mayor, the Town Clerk, and one other councillor, who must also affix their signatures to the document.
