WCC, District Scheme 1985 and Transitional District Plan

Archives Identifier00307Date Range1985-1994DescriptionThis series contains the operative Wellington City District Scheme from 1985. The Council was required under Sections 38 and 59 of the Town and Country Planning Act 1977 to provide an Operative District Scheme for its district and review this Scheme every five years.
The first operative scheme had been produced in 1972, and the first review had been carried out in 1979. The Council was able to alter the Operative District Scheme by a formal scheme change under Sections 54 and 55 of the Act. This led to the creation of a set of files to manage that process (these form Series 00057).
The scheme was an administrative device to plan and control the development of the district. The District Scheme document includes:
• A Scheme Statement which sets out objectives that have been decide on. It also includes sections which deal with how these objectives will be implemented.
• A Code of Ordinances which sets out in more detail the exact incentives or controls upon various sorts of development for various parts or zones of the city.
• A special section dealing with Aro Valley Comprehensive Urban Renewal Area
• A set of Planning Maps showing the zoning for different sections of the city and public works and other provisions.
• Copies of the District Scheme Changes that were approved.
Under the Resource Management Act 1991 all existing District Schemes ceased to have any effect after 1 October 1991. However, existing Town Planning Schemes remained in force as Transitional District Plans. They remained operational until a new District Plan was prepared. Due to the various amalgamations and boundary changes that occurred between 1989 and 1991 the Wellington City Council Transitional District Plan included the following documents:
• The Wellington City Council District Scheme (1985)
• The Tawa Borough Council District Scheme (1988)
• That part of the Lower Hutt City District Scheme relating to the Horokiwi area (1978)
• That part of the Lambton Harbour Combined Scheme above mean high water springs
• Any part of the Wellington Harbour Maritime Planning Scheme that is above mean high water springs
• Publicly notified scheme reviews in the Horokiwi area (Lower Hutt City Proposed District Scheme Review No. 2) and the Takapu Road area (Porirua City Proposed District Scheme Review)
It also included any changes or variations to any of the above Schemes which at October 1, 1991 were not deemed operative. After the introduction of the first Proposed District Plan in 1994 the Transitional plan continued to be used and referenced, though increasingly the Proposed District Plan took precedence where the two contradicted each other. This continued until the new District Plan was made operative in 2000. Where possible each scheme that makes up the Transitional Plan has been added to this series but please note that no copy of either Lower Hutt scheme is held.
